Article 1 (Application)
These Terms of Service establish the conditions for using the mobile application "D-Live" (hereinafter referred to as "the Service") provided by D-Live (hereinafter referred to as "the Company"). Users are required to use the Service in accordance with these Terms.
Article 2 (User Registration)
To use the Service, prospective users must agree to these Terms, apply for registration using the method specified by the Company, and the registration is completed upon the Company's approval. The Company may refuse to approve a registration application if certain conditions are met.
Article 3 (Points and Exchange)
The Service awards points based on the user's driving distance and safety score. Awarded points can be exchanged for gift certificates and other rewards using the methods specified by the Company. Please check the in-app guidance for point expiration dates and exchange conditions.
Article 4 (Prohibited Activities)
Users must not engage in the following activities when using the Service: acts that violate laws or public order and morals; acts related to criminal activities; acts that destroy or interfere with the Company's servers or networks; acts that may interfere with the operation of the Company's services; acts that collect or store personal information of other users; acts of unauthorized access or attempts thereof; and other acts deemed inappropriate by the Company.
Article 5 (Suspension of Service)
The Company may suspend or interrupt all or part of the Service without prior notice to users in the following cases: when performing maintenance or updates on computer systems; when the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters; and when the Company determines that it is difficult to provide the Service.
Article 6 (Changes to Terms)
The Company may change these Terms at any time without notice to users when deemed necessary. When users begin using the Service after the Terms have been changed, they are deemed to have agreed to the revised Terms.
Article 7 (Handling of Personal Information)
The Company will handle personal information obtained through the use of the Service appropriately in accordance with the Company's Privacy Policy.
Article 8 (Disclaimer)
The Company's liability for breach of obligation shall be exempted unless due to the Company's intentional misconduct or gross negligence. The Company assumes no responsibility for transactions, communications, or disputes arising between users and other users or third parties in connection with the Service.
Article 9 (Governing Law and Jurisdiction)
The interpretation of these Terms shall be governed by Japanese law. In the event of any dispute regarding the Service, the court having jurisdiction over the location of the Company's head office shall be the agreed exclusive jurisdiction.
